Determining liability after a tour bus accident

Every driver is expected to exercise caution behind the wheel. New drivers learn about defensive driving skills and the great responsibility they have to avoid behaviors that may cause injury to others. There are some drivers, however, whom you may expect to use even more care. For example, you certainly hope your grandchild's school bus driver or the tractor trailer driver hauling a tank of flammable liquid is not impaired or texting behind the wheel.

Tour bus drivers may fall into this group. If you enjoy the comfort and convenience of trips on a tour bus, you may take for granted that the driver is conscientious and that the bus company scrupulously maintains its vehicles. Who is responsible?

It is not always easy to tell who is at fault in an accident, and a tour bus accident is no different. Fortunately, modern technology allows investigators to more thoroughly examine all aspects of an accident to make their determinations. It may take a while, but if you suffer injuries, you will want to know who is liable for the accident, for example:

  • The driver: Was he or she texting, speeding or drowsy? Had the driver been drinking?
  • The owner of the bus: Did the bus company properly vet the driver? Did they adequately maintain their buses? Did they comply with California regulations for licensed charter-party carriers?
  • The tour company: Did the tour company give due diligence to finding a reputable bus company with a clean record of safety? If the tour company owns its own buses, are the buses well maintained and the drivers certified and appropriately licensed?
  • Other vehicles: Did another driver perform an unsafe maneuver, such as cutting off the tour bus or crossing the line into your lane? Larger vehicles, such as tractor trailers, box trucks and other buses can cause tremendous damage to a tour bus.

Parties involved must take reasonable steps to keep you safe during your trip. When something goes terribly wrong, it may be a complicated task to pinpoint the source of liability. It may be equally as difficult to hold that party accountable for the pain and suffering you face as a result of the accident.
