Unsecured loads and road debris can cause deadly accidents

Every person behind the wheel of a vehicle has the responsibility to properly attach and secure any load that he or she is carrying, whether it is a privately owned vehicle or a commercial vehicle. From furniture to small pieces of trash, there can be deadly consequences when something falls off a moving vehicle.

It is possible that your car accident was the consequence of some type of road debris or unsecured load. No matter what it was, you may be able to hold the California driver accountable for the damage cause by his or her failure to properly secure things to or inside the vehicle.

Why is debris so dangerous?

Commercial vehicles and trucks transport everything from building supplies to scrap metal all the time, and it is not unusual for these things to fall off the vehicle. You may think that debris causing an accident is a rare occurrence, but in actuality, it happens all the time. According to AAA Foundation for Traffic Safety, various types of road debris played a role in approximately 200,000 accidents between 2011 and 2014.

There are laws in place to protect drivers from the dangers of unsecured loads, but they do not do much to curtail the problem of dangerous road debris. Every driver is responsible for the following steps when transporting loads of any kind:

  • Using straps, tarps or whatever else is necessary to secure a load
  • Ensuring there is no overloading of the truck or trailer
  • Driving safely and at reasonable speeds when driving with a load

Simply taking the responsibility to properly secure loads can save lives. The smallest piece of road debris can have devastating consequences, and drivers who cause serious accidents may be liable for any damages or injuries caused by negligent or reckless actions.

Who is responsible for your suffering?

If you suffered as the result of the careless actions of another person, you have the right to seek a full and fair recovery. Whether a driver failed to secure his or her load and caused your accident or other negligent actions are to blame, you have rights.

It can be difficult to know where to begin after an accident. It can be useful for you to seek a full understanding of your legal options in order to know how to move forward. An accident caused by road debris may have changed your life, but you do not have to suffer through the aftermath alone.
