Is my injury covered by workers' compensation insurance?

If you suffered an injury at work, you know how important it is to get workers' compensation benefits in order to cover your medical needs, lost wages and other accident-related losses. However, it is not always easy to actually obtain benefits, even when you believe you have a rightful claim.

It can be helpful to first learn more about the workers' compensation process, including your employer's procedures, your rights as an injured California worker and what types of injuries workers' compensation insurance covers. This information can not only help you understand if you have a claim, but may actually make the application process easier and simpler.

How do I know if my injury qualifies?

While the intent of workers' compensation insurance is to provide injured workers a way to recover financial losses after an on-the-job accident, it does not necessarily mean that all injuries will be valid grounds to file a claim. You may need to move forward with the benefits claims process if you suffered injury or illness due to the following:

  • You have a preexisting condition aggravated and made worse by your job requirements or environment.
  • You suffered an injury while you were at work but on a break, taking lunch or participating in activities sponsored by your employer.
  • You have an illness that is the result of your job or toxic exposure you faced in your workplace.
  • You are suffering as the direct result of mental or physical strain from overly strenuous work duties or an extreme amount of work-related stress.

If you feel unsure of your options or are not certain that you even have a valid claim to workers' compensation benefits, you may find it useful to begin by reaching out for help as soon as possible after your work accident.

Your right to recovery as an injured worker

As an injured employee, you have rights. One of these rights is the ability to file for and claim benefits to cover accident-related losses. From getting back lost wages you missed while in the hospital to securing the money you need to pay your medical bills, you have the right to a full and fair recovery.

Whether you know your rights or feel uncertain of what you should do after a work accident, you will always benefit from a clear explanation of the legal options currently available to you. If you have grounds to seek workers' compensation benefits, this effort is not something you have to do alone.
